Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) are a binding legal agreement between the user and Curato Stays governing access to and use of the Curato Stays website, applications, and related services, features, tools, and offerings (collectively, the “Platform”). By creating an account, accessing the Platform, or using any part of the Platform, the user agrees to these Terms and all policies incorporated by reference.

If the user does not agree to these Terms, the Platform may not be used. Curato Stays may update these Terms from time to time, and continued use after an updated version becomes effective constitutes acceptance of the revised Terms.

2. Definitions

For purposes of these Terms, “Host” means a user who lists or offers a property or related stay, “Guest” means a user who searches for, books, or stays at a listed property, “Listing” means a property, room, unit, or stay made available on the Platform, and “Reservation” means a confirmed booking between a Host and a Guest.

“Content” means text, photos, videos, audio, reviews, messages, listing copy, and other materials submitted through the Platform. “Curato Stays,” “we,” “us,” and “our” refer to the Curato Stays entity operating the Platform.

3. Platform Role

Curato Stays provides an online marketplace that enables Hosts to publish Listings and Guests to search for, book, and communicate about those Listings. Except where expressly stated otherwise in writing, Curato Stays is not the owner, operator, landlord, real estate broker, travel agency, or insurer of any Listing.

When a Reservation is confirmed, the lodging agreement is formed directly between the Host and the Guest, subject to these Terms, the Listing terms, the applicable cancellation policy, and any rules disclosed before booking. Curato Stays is not a party to that lodging agreement except to the limited extent necessary to provide the Platform, payment processing, support, or other expressly described services.

4. Eligibility and Accounts

Use of the Platform is permitted only for persons or entities that are at least 18 years old and legally capable of entering into binding contracts. A user acting for a business or organization represents that the user has authority to bind that entity.

Users must provide accurate, current, and complete registration information, keep that information updated, and maintain the confidentiality of account credentials. The account holder is responsible for activities occurring under the account, subject to non-waivable legal protections.

5. Booking and Reservations

Guests may search Listings using criteria such as destination, dates, number of guests, price, and amenities, and ranking may take into account relevance, availability, listing quality, pricing, host responsiveness, and booking history.

A Reservation is confirmed only when Curato Stays issues a booking confirmation or otherwise communicates acceptance. By making a Reservation, the Guest agrees to pay the total amount displayed at checkout, including listing price, service fees, taxes, and other disclosed charges.

Guests are responsible for reviewing the Listing description, cancellation policy, occupancy limits, house rules, check-in terms, and any special conditions before booking. Hosts are responsible for ensuring that Listings are accurate, complete, and up to date at all times.

6. Host Obligations

Hosts are solely responsible for their Listings, pricing, calendar availability, listing accuracy, permits, licenses, insurance, tax compliance, safety compliance, and compliance with leases, HOA rules, zoning restrictions, and short-term rental laws applicable to the property.

Hosts must accurately describe the accommodation type, location, amenities, privacy level, access rules, and any material condition that could affect the stay. Hosts are also responsible for the acts and omissions of co-hosts, cleaners, contractors, and anyone else assisting with the Listing.

7. Guest Responsibilities

Guests are responsible for their own conduct and for the conduct of any person they invite to or allow into a Listing. Guests must comply with house rules, occupancy limits, checkout instructions, and applicable laws at all times.

Guests may not host unauthorized parties or events, damage property, disturb neighbors, bring prohibited items, or use a Listing for illegal or unauthorized purposes. Guests are responsible for determining whether a Listing is suitable for their needs and the needs of any additional guests.

8. Fees, Taxes, and Platform Charges

Curato Stays may charge service fees, payment processing fees, cancellation fees, damage-related charges, and other amounts disclosed at checkout or in an applicable policy. Any required fee changes may be made prospectively in accordance with applicable law.

Users are responsible for applicable taxes associated with bookings or hosting activity unless Curato Stays is legally required to collect or remit them. Where Curato Stays facilitates tax collection or remittance, the user authorizes Curato Stays to do so on the user’s behalf to the extent permitted by law.

9. Off-Platform Activity Restrictions

Unless Curato Stays expressly authorizes otherwise, reservation-related payments must be made through the Platform. Hosts may not require or encourage Guests to use off-platform payment methods to avoid fees, taxes, review systems, safety tools, or dispute protections.

Hosts may not require Guests to create third-party accounts, leave third-party reviews, or take unrelated off-platform actions as a condition of booking unless expressly permitted by Curato Stays. Any approved exception must be clearly disclosed before booking.

10. Reviews and Public Feedback

After a stay, Hosts and Guests may have an opportunity to review one another. Reviews must be based on actual experience, be relevant to the stay, and comply with the Reviews Policy and Content Policy.

Curato Stays may remove, restrict, or decline to publish reviews that violate these Terms or related policies. Curato Stays is not required to independently verify the accuracy of every review before publication.

11. Content License and User Content

Parts of the Platform allow users to post or share Content. By submitting Content, the user grants Curato Stays a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, adapt, publish, display, distribute, and otherwise use that Content for operating, promoting, and improving the Platform, subject to applicable law.

The user represents that the user owns the Content or has all rights necessary to submit it and grant the license described above. The user remains solely responsible for Content that is submitted or made available through the Platform.

12. Privacy

Use of the Platform is subject to the Curato Stays Privacy Policy, which describes how personal information is collected, used, shared, retained, and protected. If a user provides another person’s personal information, the user represents that the user is authorized to do so and has complied with applicable law.

13. Prohibited Conduct

Users may not scrape, crawl, reverse engineer, hack, disrupt, or interfere with the Platform or its security features. Users may not circumvent booking systems, payment tools, search systems, fees, tax collection, moderation tools, or review mechanisms.

Users may not use the Platform to harass, discriminate against, defraud, exploit, or endanger others, or to violate any applicable law, regulation, or third-party right. Users may not misuse another person’s personal information or intellectual property.

14. Verification and Safety

Curato Stays may require identity verification, payment verification, license checks, insurance verification, background screening, or other trust-and-safety measures where permitted by law. Users agree to cooperate with reasonable verification and compliance requests.

Curato Stays may suspend access to the Platform, remove a Listing, delay or hold payouts, or take other action if Curato Stays reasonably believes such action is necessary to protect users, property, legal compliance, or the integrity of the Platform.

15. Cancellation, Refund, and Resolution Process

Reservations are subject to the applicable cancellation policy displayed before booking and to any overriding policy addressing reservation issues, host cancellations, legal requirements, or major disruptive events. Curato Stays may provide rebooking assistance, refunds, credits, or other remedies where appropriate under the applicable policy.

Users agree to cooperate in good faith with reasonable requests for information relating to booking disputes, reservation issues, refunds, or damage claims. Curato Stays may make administrative determinations based on available information, without waiving any non-waivable legal rights of the parties.

16. Disclaimers

To the fullest extent permitted by law, the Platform is provided on an “as is” and “as available” basis. Curato Stays does not guarantee uninterrupted service, error-free operation, or that any Listing will meet a user’s expectations.

Except where required by law, Curato Stays is not responsible for the acts or omissions of Hosts, Guests, co-hosts, neighbors, contractors, or third parties, including property conditions, personal injury, theft, damage, or losses arising from a stay or attempted stay.

17. Limitation of Liability

To the fullest extent permitted by law, Curato Stays will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, or business interruption arising out of or related to use of the Platform. Where liability cannot be fully excluded, Curato Stays’ total liability will be limited to the greater of the amounts paid to Curato Stays by the claimant in the 12 months preceding the claim or the minimum amount permitted by law.

18. Indemnification

The user agrees to defend, indemnify, and hold harmless Curato Stays and its affiliates, officers, directors, employees, agents, and service providers from and against claims, liabilities, damages, losses, and expenses arising from the user’s Listing, Reservation, Content, use of the Platform, or violation of these Terms, law, or third-party rights, to the extent permitted by law.

19. Suspension and Termination

A user may stop using the Platform at any time and may close an account where that functionality is made available. Curato Stays may suspend or terminate access, remove Content, cancel bookings, restrict visibility, or take other enforcement action if a user violates these Terms, violates law, creates risk, or harms users, third parties, or the Platform.

Obligations incurred before termination survive termination, including fees, taxes, damage obligations, indemnity obligations, and other provisions that by their nature should survive. Termination does not automatically extinguish liabilities arising before termination.

20. Dispute Resolution and Governing Law

Before filing a formal claim, the parties should attempt to resolve disputes in good faith through Curato Stays support or any designated resolution process. If Curato Stays adopts arbitration, class action waiver, or jurisdiction-specific venue terms, those provisions should be published in a separate regional addendum tailored to the jurisdictions in which Curato Stays operates.

These Terms are governed by the law stated in the applicable Curato Stays governing-law provision or regional supplement, without regard to conflict-of-laws rules. Users may have mandatory rights under consumer or local law that cannot be waived by contract.

21. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force to the extent permitted by law. These Terms, together with the Privacy Policy and incorporated policies, constitute the entire agreement regarding the user’s access to and use of the Platform.
