Payments Terms
1. Scope
These Payments Terms govern payment services made available through Curato Stays or its designated payment service providers in connection with Listings, Reservations, payouts, refunds, reversals, taxes, and related transactions on the Platform.
2. Payment Authorization
By submitting a payment method, the user authorizes Curato Stays and its payment partners to charge the payment method for booking charges, service fees, taxes, approved post-booking charges, damage amounts, chargeback-related amounts, and other sums due under the Terms or applicable policy.
3. Failed Payments
If a payment method is declined, expires, or otherwise fails, Curato Stays may retry the payment method, use another payment method associated with the account where permitted, suspend the account or booking, or take other lawful steps to collect the outstanding amount. The user remains responsible for unpaid balances.
4. Payouts to Hosts
Host payouts may be initiated according to the timing stated on the Platform, subject to holds, delays, reviews, fraud checks, chargeback risk, compliance obligations, account verification, or other operational requirements. Curato Stays may offset against future payouts amounts owed by the Host.
5. Chargebacks and Reversals
If a booking is subject to a chargeback, reversal, payment dispute, fraud review, or unauthorized transaction claim, Curato Stays may withhold, reverse, recover, or offset related sums. Hosts agree that payout amounts may be adjusted to reflect refunds, reversals, disputes, or associated costs.
6. Taxes
Curato Stays may collect, calculate, withhold, report, or remit taxes where required by law or where the Platform offers that functionality. Users remain responsible for taxes not collected or remitted by Curato Stays unless law provides otherwise.
7. Compliance and Holds
Curato Stays may request tax forms, identity documentation, banking information, business registration records, or other compliance materials before processing payouts or certain payments. Payouts may be delayed or withheld if documentation is incomplete, inconsistent, or required by law or payment-partner rules.
8. Off-Platform Collection Restrictions
Except where Curato Stays expressly authorizes otherwise, Hosts may not collect reservation-related amounts outside the Platform. If Curato Stays allows any off-platform charge, that charge must be clearly disclosed before booking and must comply with applicable law.
